1. Introduction

Welcome to Yanis Dewel's portfolio and services. By accessing or using my services, you agree to be bound by these Terms of Service. Please read them carefully before engaging with any services offered.

2. Services Offered

I provide the following professional services:

  • Full-stack web development (Frontend & Backend)
  • Mobile application development using Flutter
  • Java development including Minecraft mods and plugins
  • Custom software solutions for businesses
  • Hosting services (monthly subscription)
  • Maintenance and support services

3. Project Engagement

3.1 Project Scope

All projects begin with a detailed scope definition and specifications. Changes to the scope may result in additional costs and timeline adjustments.

3.2 Timeline & Deliverables

Project timelines are estimated based on the agreed scope. I use iterative development methods and provide regular updates throughout the project lifecycle.

Deliverables will be shared via agreed methods (e.g., GitHub repository, file transfer, email). It is the client's responsibility to ensure access and receipt.

3.3 Communication

Regular communication is maintained through agreed channels. Response time for non-urgent matters is typically within 24-48 hours during business days.

Clients must provide timely feedback, assets, and approvals. Delays caused by the client may affect project timelines.

3.4 Revisions

Revisions within the agreed scope are included. Any additional features or changes outside the original scope may incur additional costs.

3.5 Hosting & Maintenance

Hosting and maintenance services are available on a subscription basis (monthly, quarterly, or yearly) as specified in the project agreement.

Hosting Services Include:

  • Server management and configuration
  • SSL certificate management
  • Regular backups (daily or as agreed)
  • Security monitoring and updates
  • 99% uptime guarantee (excluding scheduled maintenance)

Maintenance Services Include:

  • Bug fixes related to original delivered code
  • Security patches and critical updates
  • Framework and dependency updates
  • Technical support via email (response within 48 hours for non-urgent matters)
  • Priority support for critical issues (response within 4-8 hours)

Additional Work (Not Included):

  • New features or functionality
  • Design changes or redesigns
  • Integration with third-party services not originally included
  • Content updates (unless specifically agreed upon)
  • Issues caused by client modifications or third-party plugins

Clients are responsible for providing required domain and access credentials. Hosting and maintenance services are billed on a recurring schedule as specified in the project agreement.

4. Payment Terms

4.1 Pricing

Pricing is determined based on project complexity, timeline, and requirements. A detailed quote will be provided before project commencement.

4.2 Payment Schedule

Payment terms are typically structured as follows:

  • 50% upfront payment upon project acceptance
  • 50% upon project completion and delivery
  • For larger projects, milestone-based payment schedules may be arranged

For hosting and maintenance services, payment may be structured as:

  • Full upfront payment for a fixed period
  • Recurring payments for ongoing maintenance (monthly, quarterly, or yearly)

4.3 Late Payments

Late payments may result in project suspension until payment is received. Communication will be made to resolve any payment delays promptly.

4.4 Recurring Payment Failures

For hosting and maintenance services with recurring payments:

  • If a payment fails, a notification will be sent immediately
  • A grace period of 7 days will be provided to resolve the payment issue
  • If payment is not received within the grace period, services may be paused or suspended
  • Reactivation of services will occur upon successful payment, subject to availability
  • Data backups will be retained for 30 days after service suspension

5. Intellectual Property

Intellectual property is distinguished between Background IP and Foreground IP. Background IP (including code, scripts, internal tools, AI prompts, methods, know-how, architectures, and reusable pre-existing or generic components) remains my exclusive property. Foreground IP (including elements developed specifically for the client's instance, such as dedicated frontend components, specific hooks and integrations, and design customizations) is assigned to the client upon full payment. The client also retains ownership of its data, including user data collected, stored, or displayed through the frontend, as well as its content, brand assets, mockups, and other business assets.

  • Reuse generic code, libraries, frameworks, and non-project-specific components in future projects
  • Grant the client an exclusive, perpetual, and transferable license to use the delivered code for operating their project, including in the event of a company transfer, merger, or sale
  • Display the project in my portfolio (unless confidentiality is agreed upon)
  • Retain ownership of any pre-existing intellectual property, methodology, or tools used

6. Confidentiality

I respect your privacy and confidentiality. Any sensitive information shared during the project will be kept confidential and will not be disclosed to third parties. A separate Non-Disclosure Agreement (NDA) can be signed upon request.

I take reasonable measures to protect client data. However, clients are responsible for securing sensitive information during project collaboration or product use.

7. Product Sales

7.1 Digital Products

Some products may be offered for sale as digital downloads (plugins, templates, tools, etc.). Upon purchase, you receive a license to use the product according to the specified license terms.

7.2 Licensing

Product licenses may include:

  • Personal License: For individual use on personal projects
  • Commercial License: For use in commercial projects or client work
  • Extended License: For resale or redistribution (where applicable)

Each product clearly states which license types are available.

7.3 Delivery

Digital products are delivered immediately after payment confirmation via download link. Download links are valid for 30 days and may be re-accessed by contacting support.

7.4 Refunds & Returns

Due to the digital nature of products, all sales are final. However, refunds may be considered in the following cases:

  • Technical issues that prevent the product from functioning as described
  • Duplicate purchases made in error (within 48 hours)
  • Product significantly differs from the description

Refund requests must be submitted within 14 days of purchase with a detailed explanation.

7.5 Updates & Support

Product purchases include:

  • Free updates for the product version purchased (e.g., v1.x updates for v1.0)
  • Basic email support for 90 days from purchase date
  • Access to documentation and installation guides

Major version upgrades (e.g., v1.x to v2.x) may require an additional purchase or upgrade fee.

Support Limitations:

  • Support covers product installation, configuration, and documented features only
  • Custom modifications, integrations, or feature requests are not included in basic support
  • Issues caused by third-party plugins, themes, or modifications are not covered
  • Support does not include website/server setup unless explicitly stated in the product description

Compatibility & Dependencies:

Products are tested with specified environments and dependencies as listed in the product documentation. Compatibility with future versions of frameworks, libraries, or platforms is not guaranteed. It is the buyer's responsibility to verify compatibility with their specific setup before purchase.

7.6 Prohibited Uses

Unless explicitly stated in an Extended License, you may not:

  • Resell, redistribute, or sublicense the product
  • Claim the product as your own work
  • Use the product in illegal or unethical applications
  • Reverse engineer or decompile the product (if applicable)

8. Warranties & Liabilities

8.1 Warranty Period

I provide a 30-day warranty period for bug fixes and issues directly related to the delivered code. This does not cover feature additions or changes in requirements.

8.2 Limitation of Liability

I am not liable for any indirect, incidental, or consequential damages arising from the use of delivered software. Maximum liability is limited to the total project cost.

8.3 Force Majeure

I am not liable for delays or failure to perform due to circumstances beyond my reasonable control, including but not limited to natural disasters, internet outages, or government restrictions.

8.4 Hosting & Maintenance Warranty

Hosting and maintenance services are provided "as-is" with reasonable efforts to maintain uptime and performance. However, I am not liable for:

  • Downtime caused by third-party hosting providers, DNS services, or internet service providers
  • Issues resulting from DDoS attacks, hacking attempts, or other malicious activities
  • Data loss due to client actions or third-party service failures (regular backups are provided but not guaranteed)
  • Service interruptions due to scheduled maintenance or emergency security updates
  • Performance issues caused by traffic spikes beyond agreed hosting plan limits
  • Issues arising from client-installed plugins, themes, or custom modifications

While a 99% uptime guarantee is targeted, actual uptime may vary due to factors outside of reasonable control. Clients are encouraged to maintain their own backups for critical data.

9. Termination

Either party may terminate the agreement with written notice. In case of termination:

  • Client is responsible for payment for work completed up to the termination date
  • All deliverables completed will be provided to the client upon payment
  • Refunds for prepaid work are calculated based on work completed

Refunds for services are only issued for work not yet started. Refunds for digital products are as per Section 7.4.

9.1 Termination of Recurring Services

For hosting and maintenance services with recurring payments:

  • Clients may cancel at any time by providing written notice at least 30 days before the next billing cycle
  • Cancellations take effect at the end of the current paid period
  • No refunds are provided for partial billing periods already paid
  • Upon cancellation, a final backup will be provided, and data will be retained for 30 days
  • Reactivation after cancellation is subject to availability and current pricing

10. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms of Service or services provided:

  • Both parties agree to first attempt to resolve the dispute through good faith negotiations
  • If negotiations fail within 30 days, either party may request mediation by a neutral third-party mediator mutually agreed upon
  • Mediation costs will be shared equally between both parties
  • If mediation is unsuccessful after 60 days, either party may pursue legal action as outlined in Section 12 (Governing Law)

This dispute resolution process does not prevent either party from seeking urgent injunctive relief in case of intellectual property violations or confidentiality breaches.

11. Modifications to Terms

I reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page. Continued use of services after changes constitutes acceptance of the modified terms.

12. Governing Law

These terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Liège, Belgium.

13. Privacy & Data Protection

I am committed to protecting personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian data protection laws.

13.1 Data Collection & Processing

When providing services, I may collect and process personal data including but not limited to: contact information, project requirements, and technical data. Data is collected only for the purpose of delivering contracted services and is not shared with third parties except as necessary for service delivery (e.g., hosting providers).

13.2 Data Storage & Security

Client data is stored on secure servers, primarily within the European Union. Reasonable technical and organizational measures are taken to protect data against unauthorized access, loss, or disclosure. However, no method of electronic storage is 100% secure, and absolute security cannot be guaranteed.

13.3 Client Rights

Under GDPR, clients have the right to:

  • Access their personal data
  • Request correction of inaccurate data
  • Request deletion of their data (subject to legal retention requirements)
  • Object to data processing
  • Request data portability

13.4 Data Retention

Personal data is retained only as long as necessary for service delivery and legal obligations. Project-related data is typically retained for 3 years after project completion for support and legal purposes. Clients may request earlier deletion subject to legal and contractual obligations.

13.5 Hosting Services & End-User Data

For hosting services, clients act as data controllers for any end-user data collected through their applications. I act as a data processor and will process data only according to client instructions. Clients are responsible for obtaining necessary consents from their end-users and complying with applicable data protection laws.
